1. Acceptance of Terms

By downloading, installing, or using Fittela (the "App"), including its website and all associated services, you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. If you do not agree to these Terms, you are prohibited from using or accessing the App.

These Terms constitute a legally binding agreement between you and Nomadan Apps ("Company," "we," "our," or "us").

2. Description of Service

Fittela is an AI virtual try-on app. You provide a photo of yourself and an image of a garment, and the App generates a new image showing you wearing that garment. The App operates without traditional user accounts -- users are identified by an anonymous device identifier.

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice.

3. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement.

4. Free Tier and Subscriptions

The App offers 1 free virtual try-on. After that, a subscription to Fittela Pro is required for continued access. Subscriptions are billed exclusively through Apple's App Store and managed by RevenueCat. All payments are subject to Apple's terms and conditions. Fittela Pro includes a fair use allowance of 50 try-ons per rolling 7-day period. This limit resets automatically and is designed to ensure service quality for all users.

  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
  • You can manage or cancel your subscription at any time through your Apple ID settings.
  • Refunds are handled by Apple according to their refund policies.
  • You may restore previous purchases at any time from the App's settings screen.

5. AI-Generated Content

The try-on images produced by Fittela are generated by artificial intelligence and are for entertainment and informational purposes only. The generated image is an AI approximation of how a garment might look on you; it may not accurately represent the actual fit, color, fabric, or appearance of the real garment and should not be relied upon as a substitute for trying on clothing in person. You are responsible for ensuring you have the rights to any photos and garment images you upload.

6. User Conduct

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Circumvent usage limits or subscription requirements
  • Use the App to distribute malware or harmful code
  • Upload photos of other people without their consent, or images you do not have the rights to use
  • Submit photos that contain illegal content

7. Intellectual Property

All content, design, graphics, code, and functionality in the App are owned by Nomadan Apps or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on the App without prior written consent.

8. Disclaimers

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. NOMADAN APPS EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NOMADAN APPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES RESULTING FROM YOUR USE OF THE APP. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU FOR ACCESSING THE APP DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

10. Third-Party Services

The App integrates with third-party services including Apple App Store, RevenueCat, Google (Gemini API), and Firebase. Each has its own terms and privacy policies.

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason including breach of these Terms.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved in the appropriate jurisdiction.
